General information

We are pleased that you are interested in telecommunication software GmbH and that you are applying or have applied for a position in our company. We would like to provide you with the following information on the processing of your personal data in connection with your application, as we attach great importance to data protection.

We strictly adhere to the legal provisions when processing data, in particular the European General Data Protection Regulation (‘GDPR’) and the new Federal Data Protection Act (‘BDSG-new’).

Types of data and purposes of processing

We process the data that you have sent us in connection with your application in order to check your suitability for the position and to carry out the application procedure. The application process requires applicants to provide us with the applicant data. Necessary applicant data includes personal details, postal and contact addresses and the documents relating to the application, such as cover letter, CV and references Applicants can also voluntarily provide us with additional information.

 

Legal basis

The legal basis for the processing of your personal data in this application procedure is primarily Art. 88 GDPR in conjunction with § Section 26 BDSG-new in the version applicable from 25/05/2018. Accordingly, the processing of data required in connection with the decision on the establishment of an employment relationship is permitted.

If you voluntarily provide us with special categories of personal data within the meaning of Art. 9 para. 1 GDPR as part of the application process, or if we request this from you as part of the application process, it will also be processed in accordance with Art. 9 para. 2 lit. b GDPR (e.g. health data if this is necessary for the exercise of the profession).

Should the data be required for legal prosecution after completion of the application process, data processing may be carried out on the basis of the requirements of Art. 6 GDPR, in particular to safeguard legitimate interests in accordance with Art. 6 para. 1 lit. f) GDPR. Our interest then lies in the assertion or defence of claims.

 

Storage duration

Your personal data will initially be stored for the duration of the application process and, in the event of rejection, for 6 months, but for a maximum of 12 months after consent, and then deleted.

In the event that you have consented to your personal data being stored for a longer period, we will transfer your data to our applicant pool for a maximum of 12 months. The legal basis in this case is Art. 6 para. 1 lit. a) (your consent, which you can revoke at any time).

If you have been accepted for a position as part of the application process, the data will be processed by us for the purposes of the employment relationship.

Receipts/accounting data for any reimbursement of travel expenses or out-of-pocket expenses are archived in accordance with tax regulations.

 

Disclosure to third parties

Your data will not be passed on to third parties. Nevertheless, your personal data may be accessed by IT companies that are contractually obliged to carry out authorised data processing and that support us in the maintenance and care of our IT systems.

Your application data will be reviewed by the personnel managers upon receipt of your application.

You will receive a confirmation of receipt in advance using the contact details you have provided us with for correspondence. Suitable applications will then be forwarded internally to the HR manager for the relevant vacancy. The next steps are then agreed. Within the company, only those persons have access to your data who need it for the proper course of our application procedure.

Your data is processed exclusively in data centres in the Federal Republic of Germany.

 

Rights of data subjects

You have the right to information about the personal data we process about you.

You also have a right to rectification or erasure or to restriction of processing. You also have the right to object to processing within the scope of the statutory provisions.

If you have provided the processed data yourself, you have the right to data portability (Art. 20 GDPR).

If the data processing is based on consent pursuant to Art. 6 para. 1 a) or Art. 9 para. 2 a) GDPR, you can revoke your consent at any time with effect for the future without affecting the legality of the previous processing. You have the right to lodge a complaint about the processing of personal data by us with the competent data protection supervisory authority.
